The fact that they met with an advocacy group members or even a hate group leader isn't so much the problem. It's the fact that they met with leaders of such a group who is an active participant in a current case. That should be a big no and is, in my eyes, improper. That sort of behavior could generate an appeal, but you can't appeal Supreme Court decision to my knowledge.

Don't give them credit they haven't earned. Neither has recused themselves. That sort of action requires objectivity.

Ordinarily I would be against packing the court. However, extraordinary times call for extraordinary measures. After the shit that McConnell, Grassley, Graham, the senate judiciary committee, and the investigators pulled, it's only fair.

Being able to pack the court means, to my mind, its architecture gives bias too much sway.  We too much care what personalities occupy its bench, and it's their biases that matter to us, not their lack of it (despite our pretending the opposite).

When the court was formed the nation was about 3.9 million people, the economy was mostly agrarian, and the oceans separated North America from the rest of the world as if they were on another planet.  Today the population is almost 10 times greater, the types of businesses perhaps 100 times greater (and certainly more complicated), and telecommunications and cheap jet travel have made the oceans no more than a thin border.  And we have learned a great deal about individual and cultural psychology.  One bench of 9 is inadequate in today's milieu.  But only adding more seats to that one bench, with the particular aim of tilting its particular bias, leaves its inadequacy unreformed.

It needs more benches.  Enlarge the court to, say, 15 benches, each bench still 9 people, or 7, but no larger than 9.  Each bench has equal supremacy; no one bench is "the" bench.  Most crucially, the benches are seated by draft; no individual personality occupies a seat for any longer than to hear a few cases.  A vetting process defines qualification for getting onto the bench; being an attorney or judge would NOT be one of the prerequisites.

That would create an architecture more equal to its task, one where turnover is its essential characteristic, erasing entrenched bias, and the draft erasing the corruptions that unavoidably infest appointment.  And when 15 benches become overburdened, add more.

I was planning to have this ready to put into place a week from now next Tuesday but other chores have interceded so others will have to take it on.  Also there might be resistance to so sweeping a change, turning the court from a cottage to a skyscraper, but change is what the court itself was created to administer.
